E-folio Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the E-folio platform (“Service”), operated by Earniversity Ltd (“we”, “us”, “our”).
By creating an account or using the Service, you agree to these Terms.
If you do not agree, you must not use the Service.
1. Eligibility & Guardian Approval
You must be at least 13 years old to use the Service.
If you are under 18, you confirm that a parent or legal guardian has reviewed and approved your use of the Service.
Where access to E-folio is provided through a school, college, council, or other organisation, that organisation may act in a supervisory role in line with its own safeguarding and acceptable-use policies.
E-folio does not independently verify guardian approval and relies on users, guardians, and partner organisations to ensure appropriate permissions are in place.
Additional eligibility requirements may apply for learners enrolled in Earniversity programmes.
2. Your Account
You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account.
You must notify us promptly if you believe your account has been accessed without permission. We are not responsible for any loss or damage arising from unauthorised account use.
3. Your Content
You may upload, embed, or link to text, images, video, documents, and other materials (“Content”).
You retain ownership of your Content. By uploading Content, you grant E-folio a non-exclusive, royalty-free licence to store, display, process, and distribute that Content solely for the purpose of operating and improving the Service.
You agree not to upload or publish Content that:
- violates any law or regulation
- infringes the rights of others
- is harmful, abusive, explicit, or inappropriate
- includes unauthorised personal data of others
- is misleading, fraudulent, or impersonates another person
- is unsuitable for the safeguarding context or intended audience
3A. Content Visibility & Responsible Sharing
E-folio allows users to choose whether their portfolio is public or restricted. Privacy controls, such as password protection, are available to help users share their E-folio appropriately.
As with most online platforms, content shared publicly may be viewed or shared by others. While E-folio provides tools to manage visibility, users should carefully consider what they choose to make public and avoid sharing sensitive or personal information.
E-folio is designed to support responsible, professional sharing, rather than social-media-style broadcasting.
3B. Search Engine Indexing
Public E-folio pages may be discoverable by search engines unless restricted by user settings.
E-folio does not guarantee whether content will or will not be indexed by third-party search engines. Users who wish to limit discoverability should use available privacy controls or avoid publishing sensitive information publicly.
3C. Personal Information, Contact Details & Downloads
Users may choose to publish contact forms, downloadable documents (such as CVs), or other materials that include personal information.
Users are responsible for ensuring that any personal information they make public is shared knowingly and appropriately. E-folio does not verify, approve, or restrict the content of uploaded documents.
4. Acceptable Use
You agree not to:
- interfere with or disrupt the Service
- attempt unauthorised access to accounts or systems
- use the Service for illegal or fraudulent purposes
- misrepresent your identity, credentials, or experience
4A. Safeguarding & Appropriate Use
E-folio is used by a broad age range, including learners under 18, and is designed to support safe, professional use.
E-folio applies a proportionate, light-touch safeguarding approach, which includes:
- regular review of publicly visible content, and
- responsive review of reported pages or materials
Where content is found to be inappropriate or in breach of these Terms, E-folio may remove content, restrict visibility, suspend accounts, or terminate access.
E-folio also provides guidance, reporting tools, and policies to support safe use of the platform. Parents, guardians, educators, and institutions play an important role in guiding learners on appropriate online behaviour and content sharing. (See Safeguarding Policy)
4B. Reporting Content & Concerns
E-folio provides a “Report Page” or “Report Content” feature that allows users, parents, educators, or third parties to flag concerns.
Reports are reviewed within a reasonable timeframe. Depending on the nature of the concern, E-folio may remove content, restrict access, suspend accounts, or escalate the issue to the relevant institution.
Serious safeguarding concerns should also be raised through the learner’s school, college, or safeguarding lead. (See Safeguarding Policy)
5. Platform Features & Analytics
E-folio allows users to create and customise digital portfolios, including links, media, documents, services, and integrations. Features may change as the platform evolves.
The Service includes basic analytics that allow users to view engagement such as page views and link interactions. Analytics are visible only to the account holder and are governed by the Privacy Policy.
6. Third-Party Links, Commerce & No Endorsement
E-folio may allow users to embed or link to third-party websites, platforms, or services.
E-folio acts as a presentation and linking tool only. Users are solely responsible for any services, products, or transactions they promote or link to through the platform. E-folio is not a party to any transaction between users and third parties.
Content published on E-folio represents the views and work of individual users. E-folio and Earniversity Ltd do not endorse, verify, or guarantee the accuracy, quality, or outcomes of any user content, services, or claims.
6A. Copyright & Intellectual Property Complaints
E-folio respects intellectual property rights.
If you believe content on the Service infringes your copyright or other intellectual property rights, please contact us with details of the alleged infringement.
Upon receipt of a valid notice, we may remove or restrict access to the content and take appropriate action in accordance with these Terms.
6B. Affiliate Programme
E-folio account holders may participate in the E-folio affiliate programme as individuals.
Affiliates may earn commission on payments made by users who sign up through an affiliate referral link, subject to programme rules and a minimum payout threshold of £20.
Affiliates must clearly disclose when they are promoting E-folio using an affiliate link and must represent E-folio accurately and responsibly.
E-folio reserves the right to suspend or terminate affiliate participation or withhold commission at its discretion.
Affiliates act independently and are not employees, agents, or representatives of E-folio or Earniversity Ltd.
7. Termination
We may suspend or terminate accounts that violate these Terms or misuse the Service.
Users may delete their account at any time. Upon termination, access to the Service will be revoked, although certain data may be retained where required by law or policy.
8. Privacy
Your use of the Service is governed by our Privacy Policy, which explains how personal data is collected, used, and protected.
9. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date will reflect changes.
Continued use of the Service after changes means you accept the revised Terms.
10. Disclaimer
The Service is provided “as is” and “as available.”
We do not guarantee uninterrupted, error-free, or secure operation.
11. Limitation of Liability
To the maximum extent permitted by law, E-folio and Earniversity Ltd are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
12. Indemnity
You agree to indemnify and hold harmless E-folio and Earniversity Ltd from any claims, losses, or liabilities arising from your content, misuse of the Service, or breach of these Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
